These Terms & Conditions govern your access to and use of castleflexx.com, any related websites, digital services, content, CastleFIT membership services, private sessions, products, and related offerings made available by Castle Fit Corporation, doing business as CastleFlexx (“CastleFlexx,” “we,” “us,” or “our”).
By accessing or using our website or purchasing from us, you agree to these Terms.
Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use this website or purchase products or services from us.
Products and Services
We sell physical wellness and mobility products, digital membership content, and may offer private sessions or related services. Product availability, pricing, promotions, and descriptions may change at any time without notice.
We reserve the right to limit quantities, refuse service, cancel orders, or restrict sales where we suspect fraud, abuse, unauthorized resale, or policy violations.
No Medical Advice
CastleFlexx products, videos, private sessions, educational content, and marketing materials are provided for general wellness, mobility, flexibility, recovery, fitness, and educational purposes only. They are not medical advice and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Always consult an appropriate licensed professional before beginning any exercise, stretching, recovery, or wellness routine, especially if you have pain, injury, illness, or a medical condition.
Assumption of Risk
Use of physical products, stretching tools, guided classes, mobility programs, and private sessions involves inherent risks, including risk of strain, overextension, aggravation of existing conditions, loss of balance, falls, discomfort, or injury.
By purchasing, accessing, or using our products or services, you acknowledge and voluntarily assume these risks. You are solely responsible for determining whether a product, class, or activity is appropriate for you.
Safe Use and Misuse
You agree to use all products and services only as intended and in accordance with any instructions, warnings, demonstrations, and safety guidance we provide. CastleFlexx is not responsible for injury, damage, or loss resulting from misuse, overuse, failure to follow instructions, unauthorized modifications, improper storage, or continued use despite pain, medical contraindications, or professional advice to stop.
CastleFIT Membership and Digital Services
If you enroll in CastleFIT or another digital offering:
• you agree to the pricing and billing terms disclosed at checkout
• unless otherwise stated, subscriptions may renew automatically until canceled
• you are responsible for managing cancellation before the renewal date
• access may be suspended or terminated for abuse, chargeback fraud, credential sharing, or violation of these Terms
• digital content is licensed, not sold, and is for personal, non-commercial use only
Private Sessions
If you purchase or book private sessions:
• session times are subject to availability
• rescheduling, cancellation, expiration, and no-show rules are governed by the booking terms presented at checkout or booking
• CastleFlexx may reschedule or cancel sessions when reasonably necessary
Payments
You agree to provide current, complete, and accurate billing and payment information. By submitting payment information, you authorize us and our payment processors to charge the applicable amount, including taxes, shipping, subscription renewals, and any authorized add-ons.
Returns, Refunds, and Shipping
Returns, refunds, exchanges, shipping protections, membership refund terms, and related issues are governed by our Refund Policy and any checkout-specific terms. In the event of a conflict, the more specific posted policy or offer terms control.
Intellectual Property
All website content, text, images, graphics, logos, product names, videos, software, designs, trademarks, service marks, trade dress, and other materials are owned by CastleFlexx or used with permission and are protected by law.
You may not copy, reproduce, distribute, modify, publish, transmit, create derivative works from, publicly display, or commercially exploit our materials without prior written consent.
User Content and Reviews
If you submit comments, testimonials, reviews, photos, videos, or other content, you grant CastleFlexx a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, publish, display, adapt, and distribute that content in connection with our business, subject to applicable law and our privacy practices.
You represent that your content is accurate, lawful, and does not infringe the rights of others.
Disclaimer of Warranties
Except as expressly stated in writing, the website, products, services, digital content, and related materials are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, or uninterrupted availability.
Limitation of Liability
To the fullest extent permitted by law, CastleFlexx and its officers, directors, employees, affiliates, licensors, service providers, contractors, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including loss of profits, revenue, business, goodwill, data, or use, arising out of or related to your use of the website, products, services, or content.
To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the website, products, or services will not exceed the amount you paid to CastleFlexx for the product or service giving rise to the claim in the twelve months preceding the event giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless CastleFlexx and its affiliates, officers, directors, employees, contractors, and agents from and against claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your misuse of the website, products, or services; your breach of these Terms; your violation of law; or your infringement of any right of another party.
Dispute Resolution; Binding Arbitration; Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to these Terms, the website, any product, or any service provided by CastleFlexx shall be resolved by binding individual arbitration, except that either party may bring an individual claim in small claims court if eligible.
You and CastleFlexx waive any right to a jury trial and any right to participate in a class action, class arbitration, private attorney general action, or representative proceeding.
Arbitration shall be administered by [AAA/JAMS] under its applicable consumer rules, and the arbitration shall take place in [Fulton County, Georgia], unless otherwise required by law.
Governing Law
These Terms and any dispute between you and CastleFlexx will be governed by the laws of the State of Georgia, without regard to conflict-of-law rules, except to the extent preempted by federal law.
Changes to Terms
We may update these Terms from time to time by posting the revised version on our website. Your continued use after the effective date of revised Terms constitutes acceptance of the updated Terms.
